Definitions

  • "Photographer" refers to HMPhotography.

  • "Client" refers to the person(s) booking photography services.

  • "Session" refers to the scheduled photography appointment.

Booking and Payment

  1. All sessions must be confirmed via a quote or bespoke form and will be followed by an email confirmation from the Photographer.

  2. Full payment is required via bank transfer to secure your session date and time. The session date is not confirmed until full payment has been received.

The Session

  1. Session Duration: The duration of the session is based on the package chosen by the Client. Sessions will begin at the agreed-upon time.

  2. Client & Dog Responsibilities: The Client is responsible for ensuring their dog is prepared for the session as outlined in our FAQ page (e.g., walked, groomed, and with favourite treats/toys).

  3. Dog Behaviour: The Photographer will make every effort to capture high-quality images. However, if a dog is uncooperative, unruly, or shows aggression, it may not be possible to reach the minimum number of photos offered in the package. The Photographer will not be held responsible for a reduced gallery count due to a dog's behaviour. The session will not be rescheduled or refunded in this instance.

  4. Client Behaviour: The Client must not physically or verbally abuse the Photographer or any of their staff. Such behaviour will result in the immediate termination of the Session, with no refund given.

Cancellations and Rescheduling

  1. Rescheduling by the Client: Clients are permitted one free reschedule of their session. Any subsequent reschedules by the Client will incur a £20 administrative fee.

  2. Weather-Related Rescheduling: The Photographer reserves the right to reschedule a session at their discretion if weather conditions (e.g., heavy rain) are deemed unsuitable. In this case, rescheduling is free of charge.

  3. Cancellation by the Photographer: The Photographer reserves the right to reschedule due to illness, emergency, or unforeseen circumstances.

  4. No Refunds: Payments are non-refundable, as they secure your session date and time.

Image Delivery

  1. Delivery Timeframe: Final edited images will be delivered within two weeks of the session date.

  2. Delivery Method: Images will be provided to the Client via a private, secure online gallery.

  3. Image Count: The number of final images delivered is based on the package purchased. The Photographer is not obligated to provide more images than specified in the package details.

Copyright and Usage

  1. Intellectual Property: All images remain the exclusive intellectual property of HMPhotography.

  2. Client Usage: The Client is granted full personal use rights, allowing them to download, share, and print the images for personal use only.

  3. No Commercial Use: Images may not be used for any commercial purpose without the express written permission of HMPhotography. This includes providing the images to other businesses for their own promotional use.

  4. Portfolio Use: The Photographer may use the images for their portfolio, website, marketing, and social media. If the Client wishes to keep their images private, they must notify the Photographer in writing before the session.

Image Editing

  1. Artistic Style: The Photographer's artistic style will be maintained in all edits. The Client agrees to the Photographer’s editing style upon booking.

  2. Editing Scope: The Photographer will perform standard editing, which includes colour correction, minor adjustments, and the removal of leashes. Extensive editing beyond this may incur additional charges.

  3. RAW Files: Unedited RAW files are not included in any package and will not be provided under any circumstances.

Liability

  1. Safety: The Client is responsible for their own safety and the safety of their dog(s) during the session. The Photographer is not liable for any injuries that occur.

  2. Force Majeure: The Photographer is not liable for any failure to perform due to circumstances beyond their reasonable control.

Complaints

  1. Any complaints must be submitted in writing within 14 days of the final image delivery.

  2. The Photographer will respond to the complaint within 7 working days.
